Section 16
Controls on the Importation of Foreign Publications
(1) The Government of Nepal may issue an order prohibiting the importation of foreign publications having the following purpose or containing content that may have such possible consequences:-
(a) Doing things against the national interest and dignity,
(b) Disturbing the peace, order and security of the nation, repealed by Ordinance, 2062 to amend some Nepal Acts related to communication, and automatically awakened by the Act, 2063 to establish the order of some Nepal Acts.
(c) disrupting relations with foreign states and governments,
(d) creating animosity and spreading communal ill will among people of different castes, religions, classes, regions, sects, and
(e) To harm the morality, ethics and social dignity of the common people.
(2) If it is suspected that the publication which has been stopped as per sub-section (1) is about to be smuggled, the concerned customs or postal officer shall stop such goods and send two copies of the suspected publication to the local authority with invoice and keep the rest with him.
(3) Upon receipt of the publication sent by the customs or postmaster in accordance with sub-section (2), if there is any reason to stop such publication, the local authority shall give notice to the importer stating the reason and if there is no reason to stop, the customs or postmaster shall stop the publication within twelve hours of receiving such publication. The publication should be ordered to be returned to the importer.
(4) The Government of Nepal may remove the ban imposed under sub-section (1) at any time if it deems it necessary.
